Statement from Democratic Party Chairman Phil Johnston regarding the SJC decision to uphold the March 2 special election in the Norfolk, Bristol and Middlesex Senate District

January 7, 2004

“I am very pleased with this morning's decision by the Massachusetts Supreme Judicial Court, which affirmed the Attorney General's argument that the date of the special election is not only legal under the state Constitution, it is completely fair. With remarkable speed, the court wholly rejected the Republican Party's claim that the March 2 special election date is unconstitutional and unfair.

Today's court ruling completely validates the Senate President's decision to schedule this special election in the timeframe allowed under the state Constitution. While it is important that the March 2 date will not create an additional financial burden for the taxpayers of this district, I have always believed that holding this special election in a timely manner will benefit all the people of the Norfolk, Bristol and Middlesex senate district who are now assured of representation during the critical budget debates for next year.

With this baseless legal challenge behind us, the Democratic Party and the Democratic candidates will now be entirely focused on electing a person who will continue to support the values and policies espoused by Senator Cheryl Jacques.”
